1. Agreement to Terms
By engaging EagleWatch Secure Systems Inc. ("Company," "we," "us," or "our") for security camera installation services, you ("Customer," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Provided
EagleWatch Secure Systems Inc. provides professional security camera installation services in the Greater Toronto Area, including:
- Site assessment and consultation
- Supply and installation of security camera systems
- System configuration and setup
- Customer training on system operation
- Ongoing technical support
3. Quotes and Pricing
All quotes provided are valid for 30 days from the date of issue. Prices include equipment, installation labor, and applicable taxes unless otherwise stated. Additional charges may apply for:
- Work outside the original scope
- Structural modifications required for installation
- Premium mounting locations requiring special equipment
- Expedited installation requests
4. Payment Terms
A 50% deposit is required to schedule your installation. The remaining balance is due upon completion of the installation. We accept cash, e-transfer, credit cards, and financing options (subject to approval). All sales are final once installation is complete.
5. Installation and Access
You agree to provide reasonable access to your property for installation. This includes:
- Clear access to installation areas
- Permission to drill holes and run cables as needed
- Access to electrical outlets and network equipment
- Presence of an authorized adult during installation
We will make every effort to minimize disruption and clean up thoroughly after installation.
6. Warranty
EagleWatch Secure Systems Inc. provides a 1-year labor warranty on all installations. This warranty covers:
- Defects in workmanship
- Cable and connection issues
- System configuration problems
Equipment warranties are provided by the manufacturer and vary by product. The warranty does not cover damage caused by misuse, accidents, power surges, lightning strikes, or unauthorized modifications.
7. Technical Support
We provide technical support for all systems we install during the warranty period. This includes:
- Phone and text support during business hours
- Remote troubleshooting assistance
- Guidance on system operation and mobile app usage
On-site service calls after the warranty period may incur a service fee. Post-warranty support is available at standard service rates.
8. Customer Responsibilities
You are responsible for:
- Maintaining your internet connection for remote viewing features
- Keeping login credentials secure
- Complying with local laws regarding surveillance
- Informing relevant parties about camera placement on your property
- Regular maintenance such as cleaning camera lenses
9. Privacy and Recording Laws
You are solely responsible for ensuring your use of the security system complies with all applicable privacy laws and regulations. Generally in Ontario:
- You may record on your own property
- Cameras should not capture neighboring private areas
- Audio recording may have additional restrictions
We recommend consulting legal counsel if you have questions about surveillance laws.
10. Limitation of Liability
Important: Security cameras are a deterrent and documentation tool. They do not prevent crime and are not a substitute for law enforcement, alarm monitoring services, or insurance. By using our services, you acknowledge and agree to the following limitations:
System Performance Limitations
EagleWatch Secure Systems is not responsible for:
- Power Outages: System failures, recording interruptions, or data loss caused by power outages, surges, brownouts, or electrical issues beyond our control
- Internet Connectivity: Remote viewing unavailability, notification delays, or app connectivity issues caused by your internet service provider, network equipment, or internet outages
- Recording Failures: Missed recordings due to storage device (NVR/hard drive) failures, corruption, or capacity limitations
- Mobile App Issues: Third-party mobile application bugs, updates, compatibility issues, or service interruptions from app providers
- Equipment Malfunction: Camera or equipment failures after the warranty period, or failures caused by extreme weather, vandalism, physical damage, or improper use
- Firmware/Software Updates: Issues arising from manufacturer firmware updates or changes to third-party software integrations
No Guarantee Against Crime
We do not guarantee that our systems will prevent break-ins, theft, property damage, personal injury, or any criminal activity. Cameras may fail to capture footage due to angles, lighting, obstructions, weather conditions, or technical issues. The presence of cameras does not ensure safety.
Third-Party Services
We are not responsible for the performance, availability, or reliability of third-party services including but not limited to: mobile viewing applications, cloud backup services (if applicable), network equipment, or internet service providers.
Data Loss and Corruption
While we install quality equipment, hard drives and storage devices can fail. We are not responsible for:
- Data loss due to hard drive failure, corruption, or malfunction
- Footage lost due to overwriting (based on storage capacity settings)
- Inability to retrieve footage for insurance claims or legal proceedings
- Data recovery costs or attempts
Liability Cap
To the maximum extent permitted by Ontario law, our total liability for any claims arising from our services, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount you paid for our installation services. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill.
Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to: natural disasters, extreme weather, pandemic, government actions, supply chain disruptions, or utility failures.
11. Cancellation and Rescheduling
Cancellations made more than 48 hours before scheduled installation receive a full deposit refund. Cancellations within 48 hours may forfeit the deposit. Rescheduling requests are accommodated when possible at no additional charge.
12. Indemnification
You agree to indemnify and hold harmless EagleWatch Secure Systems, its owners, employees, and contractors from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use or misuse of the security system
- Violation of privacy laws or unauthorized surveillance
- False claims or fraudulent use of footage
- Your breach of these Terms of Service
13. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes will be handled through mediation or arbitration in Ontario, Canada, in accordance with Ontario law. Both parties agree that any legal proceedings shall take place in the courts of Ontario.
14. Ontario Consumer Protection
These terms comply with the Ontario Consumer Protection Act, 2002. Nothing in these terms limits or excludes any rights you may have under applicable consumer protection legislation. In the event of any conflict between these terms and mandatory consumer protection laws, the consumer protection laws shall prevail.
As required by Ontario law:
- You have a 10-day cooling-off period for contracts signed at your home
- All prices quoted are in Canadian dollars (CAD) and include applicable taxes unless stated otherwise
- You will receive a written copy of any contract at the time of signing
15. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms of Service, together with any written quotes and installation agreements, constitute the entire agreement between you and EagleWatch Secure Systems Inc. regarding our services. Any prior representations, negotiations, or agreements not included herein shall have no effect.
17. Changes to Terms
We reserve the right to modify these terms at any time. Updated terms will be posted on our website with a new "Last Updated" date. Changes will not apply retroactively to services already completed. Continued use of our services after changes constitutes acceptance of the new terms.

19. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.
